I would certainly say that what this guy is doing is completely illegal. Its just ridiculous, selling the games that people have worked hard to make for his own personal gain, without their consent. I'm sure though that he WILL be shut down before he even has a chance to get a game out.

If Lab Rat #37 does not generate money in any way, then yes it's okay.
Otherwise I would have to decline as I've made it total freeware as of last
month. So if the DVD was the free extra in a magazine you'd have to
otherwise pay for, that'd be fine, but somehow charging for the standalone
DVD would not be. Please let me know what happens with the issue, it sounds
interesting.
